Performance Agreement
THIS AGREEMENT is made this ___ day of _______, 200__, by and between ________________________, on behalf of (______PROMOTER, VENUE OR ORGANIZATION NAME AND ADDRESS________) and Arvel Bird (hereinafter called Artist), c/o Arvel Bird, LLC, 9 Music Square South, #262, Nashville, TN 37203.
It is mutually agreed between the parties as follows:
Buyer hereby engages Artist, and Artist agrees to perform, the engagement hereinafter provided upon all of the terms and conditions set forth.

GUEST JOHN LONE EAGLE, OR SPECIAL GUEST ONE NATION)

Technical Requirements: Buyer will provide a minimum 20’ x 20’ stage, professional sound equipment and technician Artist will provide his own personal instruments and gear. A stage plot and technical list will be made available to sound company NLT ______.
Merchandise Requirements: 10 x 20’ merchandise booth table in reasonable proximity to the stage area.
Compensation and Payment: $ ________ (_________________ Dollars), plus travel and lodging. A non-refundable deposit of $___________ (equal to 25% of contract price) shall be paid upon the signing of this Agreement, but no later than _______________________, made payable to Arvel Bird, LLC. The balance of $______________ shall be in cash or by business check made payable to Arvel Bird, LLC and given to Kimberly Kelley, upon arrival on _____, _______________, prior to the start of the performance unless other arrangements have been made.
Cancellation Policy: Engagements cancelled through no fault of the Artist shall be sent via email at info@singingwolfrecords.com or by fax (866) 445-6406. If notification is received 90 days or less prior to engagement, a cancellation fee of $_______ (equal to 25% of the total contract price) shall be paid by check and mailed to Arvel Bird, 9 Music Square South, #262, Nashville, TN 37203 within 7 days of notification of cancellation. If notification is received 60 days or less prior to engagement, a cancellation fee of $__________ (equal to 50% of the total contract price) shall be paid by check and mailed to Arvel Bird, 9 Music Square South, #262, Nashville, TN 37203 within 7 days of notification of cancellation. If notification is received 30 days or less prior to engagement the full remaining balance of $______ (equal to 75% of the total contract price) shall be paid by check and mailed to Arvel Bird, 9 Music Square South, #262, Nashville, TN 37203 within 7 days of notification of cancellation.
If Artist cancels his performance other than for acts of God or other events out of artist’s control, notification shall be made immediately by email or fax and the deposit shall be returned to the issuer within 7 days of the notification date.
Miscellaneous:
Artist grants Buyer the right to use video and audio recording of
the performance for the purpose of promotions.
It is understood that the video and audio portion of artist’s
performance will not be commercially sold.
